Rules for buying and selling goods in the online store “wellmer.lt”

1. General provisions

1.1. These Rules of Purchase and Sale of Goods (hereinafter referred to as the “Rules”), upon acceptance by the Buyer (after reading the Rules and ticking the box “I have read and agree to the Purchase and Sale Rules”), are a legal document binding on the Buyer and the Seller. and obligations, conditions of purchase and payment for goods, the procedure of delivery and return of goods, liability of the parties and other provisions related to the purchase and sale of goods in the “wellmer.lt” online store.

1.2. The Seller reserves the right to change, amend or supplement the Rules at any time, taking into account the requirements established by legal acts.

1.3. You have the right to buy in our e-shop:

1.3.1. able-bodied natural persons, i. persons who have reached the age of majority and whose legal capacity is not restricted by court order;

1.3.2. minors between the ages of fourteen and eighteen, only with the consent of their parents or guardians, unless they have their own income;

1.3.3. legal entities;

1.3.4. authorized representatives of all the above persons.

1.4. By accepting the Rules, the Buyer confirms that in accordance with Article 1.3. he has the right to buy goods in the “wellmer.lt” online store.

2. Protection of personal data

2.1. When ordering the goods, the Buyer must indicate in the relevant information fields provided by the Seller his personal data necessary for the proper execution of the order: name, surname, delivery address, telephone number and e-mail address.

2.2. By approving these Rules, the Buyer agrees that 2.1. his personal data specified in point 1 would be processed in the e-shop wellmer.lt for the sale of goods and services only for the purposes of proper e-commerce.

2.3. By agreeing to the processing of his personal data for the purpose of selling goods and services in the Seller’s e-shop, the Buyer also agrees to send to the e-mail address and telephone number specified by him the information notices necessary to complete the order.

2.4. The Seller confirms that the personal data provided by the Buyer will be processed only in the e-shop selling goods and services wellmer.lt. The Seller undertakes not to disclose the Buyer’s personal data to third parties, except for the Seller’s partners providing delivery of goods or other services related to the proper execution of the Buyer’s order. In all other cases, the Buyer’s personal data may be disclosed to third parties only in accordance with the procedure provided for by the legal acts of the Republic of Lithuania.

2.5. In accordance with Article 9.2.2. point, the Buyer’s identity document submitted to the Seller’s or Lietuvos paštas employee and the Buyer’s data contained therein shall be used only for proper personal identification.

3. The moment of concluding the purchase-sale agreement

3.1. The agreement between the Buyer and the Seller is considered concluded from the moment when the Buyer, having selected the purchased item (s) and formed a shopping cart, clicks on the link “Pay”.

3.2. Each purchase and sale agreement concluded between the Buyer and the Seller is registered and stored in the database of the wellmer.lt online store.

4. Buyer’s rights

4.1. The Buyer has the right to purchase goods in the “wellmer.lt” online store in accordance with the procedure established in these Rules and other information sections of the Seller’s online store.

4.2. Pursuant to the provisions of the legal acts of the Republic of Lithuania regulating the legal relations between the Seller and the Buyer, the Buyer has the right to withdraw from the purchase and sale agreement concluded with the wellmer.lt online store by notifying the Seller in writing ) not later than within 10 (ten) working days from the day of delivery of the item.

4.3. Rules 4.2. The Buyer may exercise the right provided for in paragraph 1 only if the goods have not been damaged or their appearance has not substantially changed, nor has it been used.

5. Obligations of the Buyer

5.1. The Buyer must pay for the goods and accept them in accordance with the procedure established by these Rules.

5.2. If the data provided in the registration form of the registered Buyer changes, he must update them immediately.

5.3. By using the wellmer.lt online store, the Buyer undertakes to comply with these Rules, other conditions clearly indicated in the online store, and not to violate the legal acts of the Republic of Lithuania.

6. Seller’s Rights

6.1. If the Buyer tries to damage the stability and security of the online store or violates its obligations, the Seller has the right to immediately and without notice restrict or suspend his access to the online store or, in exceptional cases, cancel the Buyer’s registration.

6.2. In the event of significant circumstances, the Seller may temporarily or permanently terminate the operation of the online store without notifying the Buyer in advance.

6.3. The Seller has the right to cancel his order without notifying the Buyer in advance, if the Buyer does not pay for the goods within 14 (fourteen) working days.

7. Obligations of the Seller

7.1. The Seller undertakes to provide the Buyer with the opportunity to use the services provided by the online store “wellmer.lt” under the conditions set forth in these Rules and the online store.

7.2. The Seller undertakes to respect the Buyer’s right to privacy of personal information belonging to him, i. To process the personal data specified by the Buyer only in accordance with the procedure established in Chapter 2 of the Rules and legal acts of the Republic of Lithuania.

7.3. The Seller undertakes to deliver the goods ordered by the Buyer to the address specified by the Buyer under the conditions specified in Section 9 of the Rules.

7.4. The Seller, unable to deliver the ordered goods to the Buyer due to important circumstances, undertakes to offer a similar or as similar a product as possible. If the Buyer refuses to accept a similar or most similar product, the Seller undertakes to return the money paid to the Buyer within 5 (five) working days, if the advance payment has been made.

7.5. Upon the Buyer’s use of the Rules 4.2. provided for in paragraph 4.3. the Seller undertakes to return the money paid to the Buyer within 10 (ten) working days from the date of receipt of the returned goods.

8. Prices of goods, payment procedure and terms

8.1. The prices of the goods in the online store and in the formed order are indicated in euros without VAT.

8.2. The buyer pays for the goods in the following way:

8.2.1. Payment by bank transfer is an advance payment when the Buyer, after printing the order and going to the nearest bank branch or using electronic banking services, transfers the money to the bank account of the wellmer.lt manager.

8.2.2. Payment by electronic bank payment is a used Paysera payment module that directs you to all Lithuanian banks where you can securely pay for goods.

8.3. The order is executed and the delivery term of the goods starts to count only after receiving the payment for the goods.

9. Delivery of goods

9.1. The buyer, having chosen the delivery service at the time of ordering, undertakes to indicate the exact place of delivery of the goods.

9.2. The buyer undertakes to accept the goods himself. In the event that he is unable to accept the goods himself and the goods have been delivered to the specified address and on the basis of other data provided by the Buyer, the Buyer has no right to make claims to the Seller regarding delivery of goods to the wrong entity. When picking up the goods, it is necessary to have a valid identity document (identity card, passport or a new model driving license) with you and present it to the authorized employee.

9.3. The Seller delivers the goods to the Buyer in accordance with the terms specified in the descriptions of the goods. These deadlines are preliminary and do not apply in cases when the required goods are not in the Seller’s warehouse and the Buyer is informed about the shortage of the goods ordered by him. At the same time, the Buyer agrees that in exceptional cases the delivery of goods may be delayed due to unforeseen circumstances beyond the control of the Seller. In this case, the Seller undertakes to contact the Buyer immediately and agree on the terms of delivery.

9.4. In all cases, the Seller is released from liability for violation of the terms of delivery of goods, if the goods are not delivered to the Buyer or are not delivered on time due to the fault of the Buyer or due to circumstances beyond the Buyer’s control.

9.5. At the time of delivery of the goods to the Buyer, the Buyer must together with the Seller or his authorized representative check the condition of the consignment and the goods (ies) and sign the delivery-acceptance document of the consignment. After the Buyer signs the delivery-acceptance document of the consignment, it is considered that the consignment has been delivered in good condition, there are no damage to the goods, the cause of which is not due to factory defects, and no discrepancies in the product (s). If the Customer notices that the packaging of the submitted consignment is damaged (wrinkled, wet or otherwise externally damaged), the product (s) is / are damaged and / or the product (s) is not in a complete set, the Buyer must indicate this in the delivery-acceptance document of the consignment and , in the presence of the Seller or his representative, to draw up a report of damage / non-conformity of the free-form consignment and / or the product (s). If the Buyer fails to do so, the Seller shall be released from liability to the Buyer for damage to the goods, if the cause of such damage is not a factory defect and due to discrepancies in the assembly of goods, if these discrepancies can be identified during external inspection.

10. Quality of goods

10.1. The Seller is not responsible for the fact that the goods in the online store in their color, shape or other parameters may not correspond to the actual size, shape and color of the goods due to the characteristics of the monitor used by the Buyer.

11. Return and exchange of goods

11.1. Defects of the sold goods are eliminated, low-quality goods are replaced, returned in accordance with the provisions of the legal acts of the Republic of Lithuania.

11.2. The Buyer may return the goods within 10 (ten) working days from the day of delivery of the goods to him, informing the Seller thereof 4.2. In accordance with the procedure provided for in the Rules.

11.3. When the buyer returns the goods, the following conditions must be met:

11.3.1. the returned goods must be in the original neat packaging (this item does not apply in the case of returning defective goods);

11.3.2. the goods must be undamaged by the Buyer;

11.3.3. the goods must be unused without losing their appearance (this item does not apply in the case of return of defective goods);

11.3.4. the returned goods must be in the same configuration as received by the Buyer;

11.3.5. when returning the goods, it is necessary to present the document of its purchase.

11.4. The Seller has the right not to accept the goods returned by the Buyer if the Buyer does not follow the procedure for returning the goods set out in this Article.

11.5. In all cases, the money for the returned goods is transferred by payment order and only to the payer’s bank account.

12. Liability

12.1. The buyer is fully responsible for the accuracy of the personal data provided by him. If the Buyer does not provide accurate personal data, the Seller is not responsible for the consequences and acquires the right to claim direct damages from the Buyer.

12.2. The buyer is responsible for the actions taken using this online store.

12.3. The registered Buyer is responsible for the transfer of his login data to third parties. If the services provided by wellmer.lt are used by a third party who has logged in to the online store using the Buyer’s login data, the Seller considers this person to be the Buyer.

12.4. The Seller is released from any liability in cases where the loss arises due to the fact that the Buyer, despite the Seller’s recommendations and its obligations, did not read these Rules, even though he was given such an opportunity.

12.5. In the event of damage, the guilty party compensates the other party for the direct damage.

13. Final provisions

13.1. These rules have been drawn up in accordance with the legal acts of the Republic of Lithuania.

13.2. The law of the Republic of Lithuania shall apply to the relations arising on the basis of these rules.

13.3. Any disagreement arising from the implementation of these rules shall be settled by negotiation. If no agreement is reached, disputes shall be settled in accordance with the laws of the Republic of Lithuania.[/vc_column_text][/vc_column][/vc_row]
